I revised the UK Misrepresentation Act as well as the Definition of LORD Hershell who defined fraudulent misrepresentation as a false statement made knowingly or without belief in its truth or reckless/carelessly not minding its truth or falsehood. A person is not condemned for fraud if he honestly believed his words to be true.
THEN Professor Ewan McKendrick defined the representation as a statement of fact inducing him/her to enter the contract/deal. The representation will be misrepresentation if it is false and misleads the party to whom it is addressed or if it is false and misleads the party who relied on it if it was known that this party would rely on it. Stating a false present intention/policy or falsified by later development becomes a misrepresentation’s statement of law or opinion is not a statement of fact.
I even revised the civil suit presided by Hon. Justice L.Bowen in the matter

The defendant bank made a statement about the plaintiff’s customer to the plaintiff’s bank .the statement misrepresented the financial standing of the customer for misrepresentation
